There are various parts and technicality in writing a wasiat. The most important thing to note in writing a wasiat is to understand the extend of the wasiat and will it be accepted in the eyes of the law both Islamic (Syariah) and civil. Here I shall share some information, pointers and concerns in the need and making of an Islamic wasiat.

90% of Muslims die without a will!

Did you know that the majority of Muslims in Singapore do not have a wasiat?

Some of you may think that knowing this is not a concern.

But let me tell you, 90% Muslims in Singapore passed away without a wasiat!

 

“While you are alive and well, a wasiat is just a piece of document BUT! when you passed on, a wasiat becomes your voice that will protect your interest.”

Yes, it’s a staggering statistic. Let’s give some figures to the stats shall we? If we were to assume that there are 20% of Muslims in Singapore based on the population of an est. 5.5million that’s over 900,000 Muslims that at this moment, if they were to die, do not have a wasiat left behind.

Why is this important?

“It is unfortunate to those who passed away without leaving a will”- Hadith Rasullullah Saw (Ibnu Majah)

Based on this hadith alone, it is important!

So why do you not have one? Are you not gonna die? Are you debt free? Are you really sure that you will not leave anything behind?

If any of your answers to these few questions above is a yes, then you need a wasiat!

Think about this for a second. What do you leave behind when you pass away? I assume these are some of your answers; Family? Assets? Debts?

Now if you were to expand those answers; there will be varying concern with each one of them.

If you are the sole breadwinner; The family that’s left behind; what would you think will happen to them? What will be their struggles?

Your assets; the money in your bank account, your car, your house and everything else that was yours. Who do you think will ensure its fair distribution?

Your debts, a loan from a friend perhaps or family members? Debt to god, your wish to perform the haj and other debts. Who will settle these for you?

Remember, you are not around to ensure all this happen according to what you want or wish. So why not protect yourself? Why not make sure that you have done your due diligence and can have a peace of mind that you will die in iman?

    Definition of Islamic Wasiat

    A declaration by a Muslim vouch by witnesses to authorized a trustee to manage and administer his or her estate upon death.

    Its a declaration – a means for a Muslim to ensure that whatever and whoever he or she left behind upon death is properly managed and executed accordingly.

    “It is surely unfortunate to those who died without a wasiat” 

    Hadith Rasullullah SAW – Ibnu Majah

    The Prophet SAW have warned us thru the hadith above the misfortune of leaving this life without a wasiat. Let me now list down person(s) who is in need of a wasiat.

        1. Bachelor
        2. No male heir
        3. Those with underage child
        4. Those who adopt
        5. Those with step children
        6. Those who are childless
        7. Polygamist
        8. Business owners
        9. With intentions for Wakaf
        10. Holding interest of others (Amanah)
        11. Single parent
        12. Newly converts
        13. Those who worries about their assets not being handled properly against Fardhu Syaríi onto themselves.
        14. Those with debts to others

    When do you need a wasiat?

    These are only a few of the main reasons given by the participants in our seminars and based on the percentage I dare say that if you do not have a wasiat, either one of the reasons above is yours as well.

    So, is it true that a wasiat is only for the rich? or if you are a bachelor, does that mean you do not need a wasiat? Do you know what is an Islamic wasiat for?

    Which category do you fall into?

    So what can a wasiat do for you? What benefit does it have for your family and those you left behind? Let me give share with you 3 main points.

    1. You are able to appoint an executor in your place once you are no longer around. The person who will take over your role to manage your assets.

    This is very important. When you die, be it expected or unexpected; your assets automatically becomes your estate. As in every estate, someone has to manage it, find it, collect it and distribute it. Who will that person be? 

    2. Liquidize your frozen estate by means of probate grant.

    In the event that you passed away, in most cases the next of kin shall have the power to apply for the release of your estate. But in some cases certain requirements have to be fulfilled. Hence the need for an executor. Having appoint an executor thru your wasiat, the executor shall have the power to assume your role and apply to the courts for a probate grant. http://en.wikipedia.org/wiki/Probate

    3. Debts

    “The soul of a person with debts shall be left hanging until the debt is settled”

    At one point or another whether we realize it or not, we may have been indebted to someone. This debt can be in the form of money or material and whatsoever. When we are alive we may have the intentions to pay off the debts but may find it a burden too heavy but upon death those debts will be left hanging.

    Through your wasiat we can instruct our next of kin or executor to ensure that the debts that we are aware of to be settled and indicate for them to check on if there are any debts left hanging.

     

    Why don’t Muslims have wasiats?

    What are the reason?

    Apparently there’s more than one, in fact there’s countless reasons for it.

        • Still young
        • Not important
        • No assets
        • Not married
        • No descendant (Childless)
        • Not ready to die yet
        • Still healthy
        • Poor
        • For the rich only
        • Too busy
        • My descendants will act accordingly

    These are just some of the benefits and advantages that you can get if you plan your death and make preparation.

    Remember our prophet Rasullullah SAW says

    “A Muslim who died leaving a wasiat, surely have died in the path of Islam and Sunnah, in have died in Iman and Taqwa, and sin forgiven”
